إنشاء منطقة حرة ببلدية الحدادة (ولاية سوق اهراس) بين الرؤية القانونية و الرهانات التنموية دراسة على ضوء أحكام قانون المالية 2025 و القانون 15/22

Résumé

في ظل التحولات الإقتصادية التي تشهدها الجزائر و التي تقوم أساسا على الخروج من دائرة التبعية لقطاع المحروقات و تشجيع التنويع الإقتصادي، برزت فكرة المناطق الحرة كآلية فعالة لتشجيع و جذب الإستثمار و تنشيط المبادلات التجارية ناهيك عن الدور الذي تلعبه هذه المناطق في تنمية البلديات الحدودية و مواجهة التحديات الإقتصادية و الإجتماعية، كالبطالة و التهريب و الإقتصاد الموازي، وتعد بلدية الحدادة بولاية سوق اهراس نموذجا للمناطق الحدودية التي تعاني من مشسكلات تنموية فإنشاء منطقة حرة بهذه البلدية في ظل الإمكانات التي تتوفر عليها يعتبر حلا و خيارا إستراتيجيا من شأنه أن يحول المنطقة إلى قطب إقتصادي تنموي خاصة و أن الترسانة و الإطار القانوني الذي يستند عليه في إنشاء هذه المناطق موجود، و المتمثل أساسا في قانون المالية لسنة 2025 و القانون 22/15 الذي يحدد القواعد المنظمة للمناطق الحرة، و المرسوم التنفيذي 24/168 الذي يحدد كيفية منح تسيير المنطقة الحرة، وتهدف هذه الدراسة إلى تسليط الضوء على إمكانية إنشاء منطقة حرة ببلدية الحدادة و الإنعكاسات المحتملة في ظل التحديات و الرهانات القائمة. In light of the economic transformations taking place in Algeria, which are primarily aimed at breaking free from dependency on the hydrocarbons sector and encouraging economic diversification, the idea of free zones has emerged as an effective mechanism to promote and attract investment and stimulate trade exchanges. This, along with the role these zones play in developing border municipalities and addressing economic and social challenges such as unemployment, smuggling, and the parallel economy, is noteworthy. The municipality of Haddada in Souk Ahras is a model of border areas suffering from developmental and structural issues, which has placed it among the shadow areas. Therefore, establishing a free zone in this municipality, given the available resources, is considered a solution and a strategic option that could transform the region into a developmental economic hub, especially since the legal framework and regulations supporting the establishment of these zones are in place, primarily embodied in the 2025 finance law and the law 22/15 that defines the regulations governing free zones, along with the executive decree that specifies how to manage the free zone. This study aims to highlight the potential for creating a free zone in the municipality of Haddada and the potential implications in light of the existing challenges and stakes.
