Résumé

تعالج هذه المقالة أحد أهم المواضيع المستحدثة في مجال حقوق الإنسان عامة وقانون البيئة خاصة نظرا لما تثيره من إشكالات قانونية لا يوجد لها حل لحد كتابة هذه الأسطر سوى بعض الاتفاقات الثنائية وحالات تدخل القضاء، الأمر الذي يقتض إما إيجاد صيغ قانونية جديدة تندرج تحت طائفتها هذه الفئة أو تكيف هذه الأخيرة مع النصوص المتاحة كما فعل القضاء في كثير من المناسبات. This article addresses one of the most pressing issues in the field of human rights in general and environmental law in particular, given the legal challenges it raises—challenges for which, at the time of writing, there is no solution other than certain bilateral agreements and judicial interventions, this necessitates either the creation of new legal frameworks to encompass this category or the adaptation of existing provisions to address it, as the courts have done on numerous occasions.
