Abstract: Banking disputes are complex and interconnected due to their basis in standard contracts with technical and legal features, which can create conflicts of interest between banks and their customers, or even between banks themselves. This situation can jeopardise the stability of transactions and undermine confidence in the banking system as a whole. For this reason, the Algerian legislature has allowed recourse to the courts, given the legal guarantees they provide. However, the nature of banking transactions is not always compatible with judicial proceedings, and arbitration is regarded as a more flexible, confidential, and specialised alternative method of dispute resolution. Nevertheless, arbitration raises questions about the arbitrability of certain banking disputes. We conclude that a combination of judicial and arbitral proceedings is the optimal solution, as the judiciary maintains its role in protecting public order, while arbitration provides speed, flexibility, and specialisation, thereby enhancing confidence in the banking sector and promoting the desired financial stability.
