Résumé
ملخص: يُعالج هذا البحث إشكالية تحقيق الأمان الرقمي للأسرة المسلمة في ظل التحديات التي يفرضها الانخراط المتنامي في الفضاء الرقمي، من خلال بناء إطار نظري ومعياري يستند إلى المقاصد الشرعية والضوابط القانونية. ويهدف إلى تأصيل مفهوم الأمان الرقمي الأسري وضبط حدوده الاصطلاحية، وبيان امتداداته المقاصدية في حفظ الكليات الخمس، مع تحليل التهديدات التقنية والسلوكية المرتبطة بالاختراقات، والابتزاز، والمحتويات غير الأخلاقية، وضعف الوعي الرقمي داخل الأسرة. كما يرصد تجليات الأمان الرقمي في التشريعات الوطنية والمعايير الدولية، ويستعرض الآليات الشرعية العملية من قواعد فقهية وفتاوى معاصرة وقيم تربوية داعمة للحماية الذاتية والمؤسسية. و يخلص البحث إلى أن تحقيق الأمان الرقمي الأسري يقتضي مقاربة تكاملية توظّف المقاصد الشرعية في ترشيد السياسات القانونية وبرامج التوعية، بما يعزّز مناعة الأسرة ويحافظ على خصوصيتها وهويتها في العصر الرقمي. الكلمات المفتاحية: الأمان الرقمي؛ الأسرة المسلمة؛ مقاصد الشريعة؛ الجرائم الإلكترونية؛ التشريعات الوطنية. Abstract : This research addresses how to ensure digital safety for the Muslim family amid intensifying engagement with online environments, by developing a theoretical and normative framework grounded in Islamic higher objectives (maqāṣid) and contemporary legal regulations. It aims to conceptualize family digital safety, delineate its scope, and relate it to the protection of the five essentials (religion, life, intellect, lineage, and property), while analysing major technical and behavioural threats such as cyber‑attacks, online blackmail, exposure to unethical content, and low levels of digital literacy within families. The research also reviews how family digital safety is reflected in selected national legislations and international standards, and outlines practical Sharīʿah‑based mechanisms—legal maxims, contemporary fatwas, and value‑oriented educational approaches—to support both self‑regulation and institutional protection. It concludes that effective family digital safety requires an integrated approach that employs maqāṣid to guide legal policy and awareness programmes, thereby strengthening family resilience and safeguarding its privacy and identity in the digital age.
