القيمة القانونية لديباجة الدستور في الكتلة الدستورية التي يقيس من خلالها القاضي الدستوري عند ممارسته الرقابة على دستورية القوانين مدى مشروعية النص المعروض عليه، للكتلة الدستورية تعريف ضيق يكمن في المرجعية للقواعد الدستورية فقط، وآخر واسع يكمن في جميع القواعد التي تسمو القانون العادي فالتعريف الضيق يسري على ديباجة الدستور التي لها نفس القيمة القانونية للنصوص الدستورية، حيث أن أراء الفقه الدستوري الفرنسي تباينت حول القيمة القانونية لإعلان الحقوق الانسان والمواطن للثورة الفرنسية قبل تضمين ديباجة دستور 1946 مبادئ هذا اعلان، لكن عندما أقر المجلس الدستوري الفرنسي القيمة القانونية لمقدمة الدستور 1946 باعتبارها جزءا لا يتجزأ من الدستور، وهذا هو موقف المؤسس الدستوري الجزائري في التعديل الدستوري لسنة 2020 في الفقرة الأخيرة من الديباجة. The legal value of the preamble within the constitutional block constitutes the standard by which the constitutional judge, when exercising judicial review of the constitutionality of legislation, assesses the legitimacy of the provision submitted for scrutiny. The constitutional block may be defined narrowly as referring solely to constitutional norms, or broadly as encompassing all rules that prevail over ordinary law. Under the narrow definition, the preamble falls within the constitutional reference framework, as it enjoys the same legal value as constitutional provisions. French constitutional doctrine long differed over the legal value of the Declaration of the Rights of Man and of the Citizen of the French Revolution before its principles were incorporated into the Preamble of the 1946 Constitution. However, the debate was settled when the French Constitutional Council recognized the binding legal value of the 1946 Preamble as an integral part of the Constitution. This approach was likewise adopted by the Algerian constitutional constituent authority in the 2020 constitutional amendment, particularly in the final paragraph of the preamble, which expressly affirms its constitutional authority.
