Résumé

الملخص: تسعى هذه الدراسة إلى تحليل الدور الذي تضطلع به كلٌّ من المسؤولية المدنية والجزائية في الحدّ من حوادث المرور والوقاية منها. إذ يُعدّ الحق، في مدلوله العام، مصلحةً ماديةً أو معنويةً يقرّها القانون ويحميها، وتتحقق هذه الحماية من خلال مساءلة من يرتكب فعلاً ضارًّا يُسبّب أذًى للغير، وتكتسي هذه المسؤولية أهمية متزايدة في ظلّ الارتفاع المستمرّ في وتيرة حوادث الطرق، لما تُخلّفه من أضرار لا تقتصر على الذمة المالية للأفراد فحسب، بل تمتد لتصيبهم في سلامتهم الجسدية بدرجات متفاوتة قد تبلغ حدّ الوفاة. ومن ثمّ، تتناول هذه الدراسة تحديد ماهية المسؤولية المترتبة على مرتكب الحادث، وبيان مضمونها، ومدى فعالية النظام القانوني القائم في تحقيق الردع والكفاية في مواجهة هذه الظاهرة. Abstract: This study seeks to analyze the role played by civil and criminal liability in reducing and preventing traffic accidents. In general terms, a right is a material or moral interest recognized and protected by law. This protection is achieved by holding accountable those who commit harmful acts that cause harm to others. This responsibility is becoming increasingly important in light of the continuous rise in the rate of road accidents, as the damage they cause is not limited to the financial liability of individuals, but extends to affect their physical safety to varying degrees, which may even lead to death. This study therefore addresses the nature of the liability of the perpetrator of the accident, its content, and the effectiveness of the existing legal system in achieving deterrence and adequacy in addressing this phenomenon.
