حماية البيئة في مجال الصفقات العمومية في التشريع الجزائري (بين النظرية والتطبيق)

Résumé

تهدف هذه الورقة الى البحث في مدى إدراج البعد البيئي في الصفقات العمومية في التشريع الجزائري، والمجهودات المبذولة من طرف السلطات العمومية لأجل تجسيد الجانب النظري على الواقع العملي وذلك من خلال تطبيق النصوص التشريعية والتنظيمية المتعلقة بحماية البيئة في كل عملية تخص الطلب العمومي، سواء خلال مرحلة تحضير أو إبرام أو تنفيذ الصفقة العمومية. وقد خلصت الدراسة الى مجموعة من النتائج، تتمثل في تثمين ما قام به المشرع الجزائري في هذا المجال من جهة اولى، وضرورة تعزيز اليات حماية البيئة في الصفقات العمومية من جهة ثانية، وذلك من خلال اعتماد معايير بيئية تأخذ بعين الاعتبار عند اختيار المتعاقد، مع منح هامش افضلية للصفقات الإيكولوجية، و كذا ادراج الفاعلين في مجال حماية البيئة ضمن اعضاء لجان الصفقات المختلفة، مع الإسراع في استصدار النصوص التنظيمية المرتبطة بهذا القانون . Abstract: This paper aims to examine the extent to which the environmental dimension has been incorporated into public procurement in Algerian legislation, and the efforts made by public authorities to translate the theoretical aspect into practical reality. This is achieved by applying legislative and regulatory texts related to environmental protection in every process related to public procurement, whether during the preparation, conclusion, or implementation phase of the public procurement. The study concluded with a set of results, including, on the one hand, the appreciation of the Algerian legislator's efforts in this area, and, on the other hand, the necessity of strengthening environmental protection mechanisms in public procurement , particularly those related to adopting environmental standards that are taken into account when selecting a contractor, while granting a margin of preference to ecological procurement, and including environmental protection actors among the members. Various procurement committees, with the expedited issuance of regulatory texts related to this law.
