Résumé

ملخص: يعد أسلوب الإمتياز النمط الوحيد لاستغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة، يمنح للمستثمرين ذوي الجنسية الجزائرية بناء على دفتر شروط يحدد عن طريق التنظيم لمدة أقصاها أربعون (40) سنة قابلة للتجديد مقابل دفع إتاوة سنوية، و قد نظم المشرع هذا العقد بموجب القانون رقم 10-03 المحدد لشروط وكيفيات إستغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة، و كذا المرسوم التنفيذي رقم 10-326 المتعلق بكيفيات تطبيق حق الإمتياز لإستغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة، بالإضافة إلى المرسوم التنفيذي 21-432 الذي جاء كأداة لإستغلال العقارالفلاحي للإستصلاح . Abstract:The concession method is the only method of exploiting agricultural lands belonging to the private property of the state. It is granted to investors of Algerian nationality based on a book of conditions determined by regulation for a maximum period of forty (40) years, renewable in exchange for the payment of an annual royalty. The legislator has regulated this contract in accordance with Law No. 10. -03 specifies the conditions and methods for exploiting agricultural lands belonging to the state’s private property, as well as Executive Decree No. 10-326 relating to how to implement the concession right to exploit agricultural lands belonging to the state’s private property.
