التنظيم القانوني لنظام الصحة في الجزائر

Résumé

تهدف هذه الدراسة إلى تحليل الإطار التشريعي لنظام الصحة في الجزائر، من خلال استعراض القوانين الأساسية مثل قانون الصحة رقم 18-11 وقوانين الضمان الاجتماعي، وتسليط الضوء على أوجه القوة والقصور في تطبيق هذه التشريعات. تكتسب الدراسة أهميتها من كونها تسعى إلى تقييم مدى فعالية هذه القوانين في تحقيق الحق في الصحة وتوفير خدمات مستدامة، مع التركيز على التحديات التي تواجه القطاع الصحي، كالبيروقراطية، نقص الموارد البشرية والتمويل. جاءت هذه الدراسة استجابة للحاجة إلى فهم أعمق للترابط بين النصوص القانونية والممارسات العملية في القطاع الصحي، بهدف الكشف عن الثغرات واقتراح حلول عملية لتحسين الحوكمة والاستدامة. وعليه يمكن طرح التساؤل التالي: - هل تُسهم التشريعات الصحية الحالية في الجزائر بفعالية في تحقيق الحق في الصحة وضمان استدامة النظام الصحي، أم أن هناك حاجة إلى تعديلات وإصلاحات أكثر شمولاً؟ Abstract: This study aims to analyse the legislative framework of the health system in Algeria by reviewing key laws such as the Health Law No. 18-11 and social security laws, and highlighting the strengths and shortcomings in the implementation of these legislations. The study is important because it seeks to assess the effectiveness of these laws in realising the right to health and providing sustainable services, with a focus on the challenges facing the health sector, such as bureaucracy, lack of human resources and funding. This study came in response to the need for a deeper understanding of the interconnection between legal texts and practical practices in the health sector, with the aim of identifying gaps and proposing practical solutions to improve governance and sustainability. Therefore, the following question can be posed: - Does the current health legislation in Algeria effectively contribute to realising the right to health and ensuring the sustainability of the health system, or is there a need for more comprehensive amendments and reforms?
