Résumé

من أسمى غايات الزواج الإنجاب، وهو ما يعتبر حقا للزوجين، لا يمكن الاتفاق على إسقاطه. ومسألة الإنجاب من خلال الاستعانة بالطرق العلمية اختلفت المواقف بشأنها، واعتمدها المشرع الجزائري مع شروط، أهمها كون الطرفين في علاقة زوجية صحيحة وبرضاهما. غير أن إجبار أحد الزوجين على العملية يطرح إشكالا قانونيا، وهذا ما يؤثر على مصير عقد الزواج، لأن الحق في الإنجاب حق مشترك للزوجين لا يمكن لأي أحد منهما سلبه للآخر. One of the highest purposes of marriage is procreation, which is the right of the couple, and it cannot be agreed to be dropped. The question of procreation through the use of scientific methods has varied in attitude and has been adopted by the Algerian legislature with conditions, the most important of which is that the parties are in a proper marital relationship with their consent. However, forcing one of the spouses in the process posed legal forms, which affected the fate of the marriage contract, since the right of reproduction was a common right of the spouses and could not be taken away from either of them.
