حماية المستهلك من جرائم الخداع والغش

أمام الانفتاح الاقتصادي وتدفق السلع والمنتجات المختلفة إلى السوق الجزائرية، زاد شغف الاستهلاك لدى المستهلك، وزادت معه رغبة المهني الجامحة في مضاعفة الإرباح على حسابه و بأي وسيلة كانت، ضاربا عرض الحائط احترام شروط التعاقد وما يجب أن يسود من ثقة وحسن النية، فقام باستغلال ضعف المستهلك وحاجته إلى الاستهلاك، ومارس عليه ضروبا من أفعال الخداع والغش، وأمام خطورتها على أمن المستهلك وصحته من جهة، وعلى مصالحه المادية والمعنوية من جهة ثانية، فإن المشرع الجنائي تدخل و خصها بنصوص عقابية في كل من قانون العقوبات وقانون حماية المستهلك وقمع الغش، وهذا من أجل توفير حماية كافية وفعالة للمستهلك، وعليه من الضروري أن نتعرف على أهم هذه الجرائم والآليات القانونية التي رصدت للتصدي لها. Faced with economic openness and the influx of various products on the Algerian market, the consumer's enthusiasm for consumption increased, and with it the unbridled desire of the professional to double his profits by all means, ignoring the loyalty, trust and good faith that should prevail, he therefore exploited the qualities of weakness which afflict the consumer, and he practices various acts of deception and fraud, without taking into account the safety and health of the consumer, the penal legislator intervened and distinguished them with punitive texts both in the Penal Code and in the law on consumer protection and the repression of fraud, in order to provide sufficient protection and effective to the consumer. It is therefore necessary to familiar with the most important of these crimes, as well as the legal mechanisms that have been affected to deal with them.
