مـلخـص: الكفالة العينية العقارية نوع من اتفاقات الضمان تتم بين الدائن وشخص أجنبي عن الدين يسمى الكفيل العيني، بحيث يتم بموجبها تقديم هذا الأخير عقارا كضمان للوفاء بدين المدين في حالة إعساره وهي عقد ذو طبيعة خاصة ، لم يخصه المشرع بأحكام خاصة فهو نظام هجين يجمع في أحكامه بين ما يتعلق بالكفالة كتلك الأحكام المنظمة للعلاقات الناتجة عن هذا العقد وأثارها و وكذا أحكام الرهن و الآثار المترتبة عليه بالنسبة للغير خاصة فيما يتعلق بقيده في المحافظة العقارية وما يترتب عنه من نتائج، ونجد هذه الازدواجية أيضا في طرق الانقضاء لذلك ارتأينا تقديم هذا البحث العلمي لتسليط الضوء على مدى كفاية أحكام الكفالة والرهن الرسمي لسد هذا الفراغ التشريعي . Abstract: The real estate guarantee is a type of security agreement that takes place between the creditor and a person foreign to the debt called the real sponsor, according to which the latter presents real estate as a guarantee to fulfill the debt of the debtor in the event of his insolvency. It is a contract of a special nature that the legislator did not specify with special provisions. Explain what is related to the guarantee, such as those provisions regulating the relationships resulting from this contract and its effects, as well as the provisions of mortgage and its implications for third parties, especially with regard to its restriction in real estate preservation and its consequences. Light on the adequacy of the provisions of guarantee and official mortgage to fill this legislative void.
