الدور الرقابي للسلطة العليا للشفافية في مكافحة الفساد

Résumé

ملخص: يعتبر الفساد من اخطر الجرائم على الاقتصاد الوطني بالنظر لما يسببه من استنزاف وتحويل الاموال المعدة لتلبية الحاجات العامة وتحقيق التنمية ، لهذا سعى المشرع الجزائري الى تدعيم اليات الوقاية من الفساد ومكافحته بتفعيل دور السلطة العليا للشفافية بموجب التعديل الدستوري لسنة2020حيث تم تصنيفها ضمن المؤسسات الرقابية ، وتم تغيير دورها وترقيتها من هيئة استشارية فقط الى مؤسسة استشارية رقابية ، بعدها صدر القانون رقم 22-08يحددتنظيمها وصلاحياتها،حيث تختص السلطة العليا للشفافية في مجال دورها الرقابي باخطارالجهات القضائية بجرائم الفساد ، كما تختص باجراء التحريات المالية والادارية وذلك بتدعيم استقلاليتها .Abstract: corruption is considered one of the most dangerous prohitions on the national economy in view of the misappropriation of funds prepared and transferred to meet public needs and achieve devlopment. For this reason،the Algerian legislator sought to strengthen the mechanisms of preventing and combating corruption by activating the role of the supreme authority for transparency according to the constitutional amendment of 2020،as it was classified among the oversight institutions. Its role was changed and promoted from an advisory body to a supervisory advisory institution ، after which law No22-08 was issued defining its organization and powers،and it is specialized in the field of its supervisory role in notifying the judicial authorities of corruption crimes ، and is specialized in conducting financial and administrative investigation by strengthening its independence
