الملخص باللغة العربية: يعد مبدأ التقاضي على درجتين من المبادئ الهامة في تنظيم القضائي ، بما يتيحه من نظر القضية مرتين بواسطة محكمتين مختلفتين ، وهو ما يفترض وجود تدرج في المحاكم ، سواء في النظام القضائي العادي أو الإداري ، فالفصل في القضايا يتطلب اجتهادا من القاضي ، والمجتهد قد يخطئ وقد يصيب ، كما قد يجانب الصواب في قضائه ،ولذلك فلابد من إيجاد وسيلة لمراقبة ما قضى به القاضي لإقراره إذا كان صحيحا وإلغائه أو تعديله إذا كان خاطئا، ولا يكون دلك إلا من خلال إعادة النظر في الأحكام القضائية أمام جهة أعلى من الجهة القضائية الأولى. ونظرا للأهمية البالغة لهدا المبدأ في صيانة الحقوق والحريات وضمان مبادئ المحاكمة العادلة، كرسه المؤسس الدستوري الجزائري في التعديل الدستوري الأخير في المادة المدنية والإدارية، بعد أن كان مقتصرا على المادة الجزائية، وهو ما يتطلب تعديل جملة من القوانين تطبيقا لما تضمنته أحكام التعديل الدستوري لسنة 2020. الكلمات المفتاحية: التقاضي على درجتين، التعديل الدستوري، مبادئ المحاكمة العادلة، الطعن القضائي. Abstract: The principle of litigation at two levels is one of the important principles in organizing the judiciary, as it allows the case to be considered twice by two different courts. It is correct, as it may be wrong in its judgment, and therefore it is necessary to find a way to monitor what the judge has decided to approve it if it is correct and to cancel or amend it if it is wrong, and this can only be done through a review of judicial rulings before a party higher than the first judicial authority In view of the extreme importance of this principle in maintaining rights and freedoms and ensuring the principles of a fair trial, the Algerian constitutional founder enshrined it in the last constitutional amendment in the civil and administrative article, after it was limited to the penal article, which requires the amendment of a number of laws in application of what is included in the provisions of the constitutional amendment of 2020.
