Résumé

تهدف الانتخابات التشريعية إلى تكريس الديمقراطية النيابية من خلال انتخاب أعضاء في البرلمان للممارسة الوظيفة التمثيلية والتشريعية والرقابية، ولا يتمّ ذلك إلا من خلال نظام انتخابي ديمقراطي يعزز جودة التمثيل النيابي، وهذا ما تجسد فعلا في الأمر 21-01 المتعلق بنظام الانتخابات، اذ يعد مبدأ الحق في الترشح والحق في الانتخاب الذي يتجسد من خلال القيد في القوائم الانتخابية أساس العملية الانتخابية التي تعد فيها المرحلة التحضيرية أهم مرحلة كونها مرتبطة بالناخب والمترشح، لهذا أحاط المشرع هذه المرحلة بضمانات قانونية بهدف تكريس النزاهة والشفافية في العملية الانتخابية عبر آلية الطعن الانتخابي في قرار يمس بحق الناخب والمترشح. Legislative elections are aimed at consolidating representative democracy by electing members of Parliament For the exercise of representative, legislative and oversight functions, only through a democratic electoral system that enhances the quality of representation, reflected in Ordinance 21.01, The principle of the right to stand for election and to vote is reflected in the registration of electoral lists, in which the preparatory phase is the most important one, being linked to the voter and the candidate, This is why the legislator has given this stage legal guarantees fairness and transparency, and done through the mechanism of appeal against any decision affecting the right of the voter and the candidate.
