تستهدف هذه الورقة البحثية موضوع دسترة عالمية العقاب قصد ضمان تجسيد استقلالية السلطة القضائية الوطنية الذي من شأنه دفع جميع مظاهر التدخل في الاختصاص القضائي الوطني بإشكالية تتمحور أساسا حول: تأثير ممارسة الاختصاص العالمي الجنائي حيال انتهاك القواعد الاتفاقية والتعاهدية والمُستثنى من قاعدة الرضائية على استقلالية السلطة القضائية، إذا علمنا أن الدستور الجزائري لسنة: 2020 ينادي بمبدأ عام مفاده: " القضاء سلطة مستقلة؟ تعد استقلالية السلطة القضائية أحد أهم المبادئ الأساسية التي يكفلها الدستور حيال مسائل ممارسة الاختصاص على الصعيدين الوطني والدولي، الأمر الذي يستدعي وضع نسق قانوني متكامل بين نص المادة: 163 من الدستور الجزائري لسنة: 2020 ومضمون المادة: 27 من النظام الأساسي للمحكمة الجنائية الدولية، كون ممارسة الاختصاص العالمي الجنائي القاضي بانتهاك القواعد الاتفاقية، يستدعي الملاحقة والعقاب بغض النظر عن جنسية المعتدي ومكان ارتكاب الجريمة، ولا حتى نظام الحصانة القضائية المعترف بها لفئات معينة.
