Résumé

This paper is a translation of the scientific article on "Functions and structure of legal language" with the consent of the author, Georges A.-Legault, and the journal META. In this article, the author questions the formal nature of the law and to the extent that it can be considered as a language; then, he raises the question on the relevance of the expression of "legal language" and more deeply on a structure or an organization which can gather together all the phenomena affected by the expression of "the law". Before demonstrating the possibility of unifying the law by what he calls "performative structure of legal language", the author highlights the complexity of legal language due to the multiplicity of its functions and underlines the paramount importance of the translator and the editor. هذا المقال المعنون "وظائف اللغة القانونية وبنيتها" هو ترجمة لبحث علمي لجورج أ. ليغولت والتي أنجزت بموافقة الكاتب، وبإذن من "مجلة ميطا". تساءل الكاتب في هذا البحث عن الخاصية الرسمية للقانون أولاً وإلى الحد الذي يمكن اعتباره لغة؛ ثم لفت الانتباه حول أهمية التعبير عن "اللغة القانونية" وبشكل أعمق حول البنية التي يمكن أن تجمع كل الظواهر المتأثرة بتعبير "القانون". كما وضح الكاتب إمكانية توحيد القانون بما يسميه "البنية الإنجازية للغة القانونية"، وسلط الضوء على تعقيد اللغة القانونية بسبب تعدد وظائفها وأكد على الأهمية الكبرى للمترجم والمحرر في نقل المعاني من لغة إلى أخرى.
