الأمن القانوني في التشريع الجزائري

الملخص
الأمن القانوني مصطلح قانوني يدخل ضمن المفاهيم الحديثة رغم قدمه من حيث المبدأ والمضمون ، يوفر الثقة في النصوص القانونية لدى المجتمع ،مما ينعكس إيجابا في استقرار العلاقات والمراكز القانونية للأفراد والتشريع ، تم الاهتمام الدولي به عبر التشريعات الوطنية للدول ، ومن بينها الجزائر ، التي تناولته في دستور 2020 ومختلف النصوص القانونية ، نتناول في هذه الورقة البحثية بالدراسة، الامن القانوني في التشريع الجزائري ، وكيفية تفعيله ،ضمن إشكالية رئيسية هي :كيف تناول المشرع الجزائري الامن القانوني وماهي تحديات تفعيله؟ . اقترحنا خطة للإجابة على هذه الإشكالية تكمن في مبحثين الاول الإطار المفاهيمي للأمن القانوني والمبحث الثاني تحديات تفعيل الامن القانوني في التشريع الجزائري استعملنا في هذه الدراسة المنهج الوصفي، والمنهج التحليلي. ABSTRACT: Legal security is a legal term that falls within modern concepts، despite its antiquity in terms of principle and content. It provides confidence in the legal texts of society، which is reflected positively in the stability of relationships and legal positions for individuals and legislation. International attention has been given to it through the national legislation of countries، including Algeria، which addressed it in the 2020 Constitution and various legal texts. We discuss it in this research paper. By studying، legal security in Algerian legislation، and how to activate it، within a main problem: How did the Algerian legislator deal with legal security and what are the challenges of activating it? We proposed a plan to answer this problem، which lies in two sections: the first is the conceptual framework of legal security، and the second section is the challenges of activating legal security in Algerian legislation. In this study، we used the descriptive approach and the analytical approach.
